Terms of Service

These Terms of Service (“Terms”) form an agreement between you and ScaleAI Markets (“we”, “us”) governing your use of ETEQ, including our website, dashboard and hosted Campaigns (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

If you use ETEQ on behalf of an organization, you confirm you have authority to bind that organization, and “you” refers to it. You must be at least 18 years old to create an account.

ETEQ lets you create interactive quiz funnels (“Campaigns”), capture leads, view and export lead data, and present recommended offers to visitors. We may add, change or remove features over time. We will try to give reasonable notice of changes that materially reduce core functionality.

• Provide accurate information and keep it up to date.
• Keep your credentials confidential; you are responsible for activity under your account.
• Tell us promptly at support@scaleai.markets if you suspect unauthorized access.

You own the content you add to ETEQ and the lead data your Campaigns collect (“Your Content”). You grant us a limited license to host, process, display and transmit Your Content solely to provide and improve the Service.

AI-generated questions, copy and other output created for your Campaigns are yours to use, subject to these Terms. You are responsible for reviewing generated content before publishing it and for making sure it is accurate and appropriate for your audience.

When you collect information from visitors through ETEQ, you are the controller of that data and you agree to:

• Comply with applicable privacy, consumer-protection and anti-spam laws (for example GDPR, CCPA, CAN-SPAM, TCPA and similar).
• Provide your own privacy notice where required and obtain any consent needed — including consent before sending marketing messages or making calls or texts.
• Honor visitor requests to access, correct or delete their data, and unsubscribe requests.

ETEQ lets you connect your own payment accounts, such as Stripe or PayPal, to charge for Campaign access or sell products. Payments flow directly between your visitors and your payment provider. ETEQ never holds, receives or touches your earnings.

You are solely responsible for your pricing, fulfilment, refunds, taxes, chargebacks and compliance with your payment provider’s terms. If we introduce paid ETEQ plans, pricing and billing terms will be shown before you purchase.

You agree not to use ETEQ to:

• Promote illegal products or services, or make false, misleading or deceptive claims (including unsubstantiated income or health claims).
• Collect sensitive information such as government ID numbers, full payment card details or health records through Campaign questions.
• Target or knowingly collect data from children under 16.
• Send spam, phish, distribute malware, or impersonate any person or organization.
• Infringe intellectual property or privacy rights of others.
• Interfere with, overload, scrape or reverse engineer the Service, or bypass its security or usage limits.

We may remove content or suspend Campaigns that violate these rules.

The Service, including its software, design, trademarks and the ETEQ name and logo, is owned by ScaleAI Markets and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. Feedback you share may be used to improve ETEQ without obligation to you.

Campaigns may link to websites, products and payment providers we do not control. We are not responsible for third-party content, products or terms, and your use of them is at your own risk.

You can stop using ETEQ and delete your account at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure for us or others, or if required by law. On termination, your right to use the Service ends; you can export your lead data beforehand, after which we may delete it as described in our Privacy Policy.

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any particular number of leads, conversion rate, sales or earnings. Any examples, estimates or calculators are illustrative only.

To the fullest extent permitted by law, ScaleAI Markets will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim or USD $100.

You agree to defend and indemnify ScaleAI Markets against claims, damages and costs (including reasonable legal fees) arising from Your Content, your Campaigns, your offers, your use of visitor data or your breach of these Terms.

We may update these Terms from time to time. We will post the updated version here and change the “Last updated” date; for material changes we will give notice by email or in the dashboard. Continued use after changes take effect means you accept them.

These Terms are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. Questions? Email support@scaleai.markets.
